The state and federal statutes are not identical. The feds can charge you for a different offense, that was actually the same crime, because they are not the same jurisdictions. It happens once in a while.

Edit: Now, they can recharge you for the same offense, without having to change the charge.

You assume to know how the law works and think your opinion is the only valid one. Federal and state legal systems are separate (sfexaminer.com). You can't be charged twice for the same crime in the same jursidiction. It's been this way for many decades. Now it's cast in stone.
