So are they just buying time, or do they actually think this will pass constitutional muster? Clearly it can't, but, do they really believe it can?

You never know what SCOTUS will decide.
I think the idea behind it is to coerce companies into doing their bidding. Knowing it may fail and doing it anyway suggests to me that they'll just keep ratcheting up the pressure until everyone caves.
