“No draft decision in the modern history of the court has been disclosed publicly while a case was still pending.
so what exactly is the definition of modern history? i see that being thrown around alot with regards to the leak but this has obviously happened before when was the last time it happened?
Its a bit misleading. Court decisions have been leaked previously. However, no "draft" decision has ever been leaked.
I watched a documentary on it.
Ironically, they had a leaker working on the inside on the original roe v wade, that was providing the legal team with the necessary arguments to sway ongoing opinion.
Like a spy novel but with court justices
this is not the first time a Supreme Court decision has been leaked to the public, but it is the first time the full text of a draft opinion has been leaked.
thank you
