Wasn't sure if this was a factor. If so, it squarely shifts the majority of blame to the park as they have an obligation to ensure everyone is "safely trapped" and secure. On the other hand, if it could not safely secure him and he ignored it a d he could have left the ride, and he already knew his size excluded him from safely riding, that significantly shifts things back at him and not the park.
