This is a very important point to the story. It's evidence that the prosecution knows they don't have a case.
Statute of limitations for a lawsuit for wrongful arrest is 2 years from the date of the arrest, not from the date of final adjudication. All pending charges must be resolved before you can meet the elements of "wrongful arrest". No deals, no pleas, nothing can be resolved in favor of the prosecution, otherwise, the arrest is considered proper and the cause of action can be dismissed under Rule 12b6.
Of course, prosecutors know this. If they have a case where an arrest was made and the defendant has given an indication that they will file a suit for wrongful arrest, the prosecution will drag out the litigation for 2 years to intentionally run out the clock on the statute of limitations. This intentional effort to pass the 2 year deadline is an indication that they know they will lose.
