No. No reasonable person could believe the rifle was possibly loaded.
Accidental shootings happen all the time. All reasonable people believe a weapon is always loaded.

The prosecution WANTS a mistrial. We want a not guilty or a directed verdict of not guilty if that fails.
The motion is for a mistrial with prejudice.
If successful, no retrial. Prosecution's desire to "get another kick at the cat" was addressed in the motion.
What a dumbass this prosecutor is... he probably put thousands of kids aspiring to be lawyers in the wrong direction.
