Failed depends on what you are expecting it to do. If you expect it to protect Americans from cyber attacks originating from state or non-state actors, you will be disappointed. However, if you expect it to be a vehicle to further erode the rights and freedoms of every day Americans (and especially white Americans), then it will be working just as expected.
