I think this is the key. They are not legally preventing anyone from buying homes there if there are officially no homes listed for sale publicly.
I think RTTL may be safe in the same way. Outsiders can still join and purchase shares in the LLC that translate to land they can build on, but those shares are not advertised publicly. You first have to go through their vetting process and become a member. Then they may offer to sell you shares in one of their LLCs.
