Crimes have victims. If I go have some drinks somewhere and drive home with a .15 blood alcohol level and get home just fine with no issues, who is the victim? Where is the crime?
Now if I was so impaired that I could not control my vehicle and crashed it, that should be a crime.
Crashing while drunk should carry some charge, but if the crash was not your fault it should not. If I am sitting at a red light waiting for it to turn green with a .15 BAC and someone comes along and slams into me as I am waiting on the light, the alcohol in my system did not contribute to that crash in any way and I should not be punished.'
But taking someone to jail and fining them thousands of dollars simply because they drove without incident with some alcohol on their breath. That's ridiculous.
It is a crime to drive impaired, whether you agree with the law or not. Having alcohol on your breath is not the same as being buzzed.
Who is the victim? There is no crime without a victim
If only there was some way to protect innocent drunk drivers from all these criminal houses that keep playing chicken with them...if only....then Ellen DeGeneres might of gotten to muff munch just one more time! Oh the inhumanity!
