IIRC, illegal aliens crossing the border illegally (not crossing at official checkpoints) who are detained by Border Patrol are given a future court date to evaluate their immigration status, then allowed to pass. Roughly 95% of them do not show up to court. In the meantime these benefits are available to them. That is my understanding anyway.
