The 4th Amendment, as written, only really applies to the government.

I'd call that an oversight - but I'm not sure the founders really considered the vast collection of information that corporations would have today.

Well sure they didn't but if you think about the spirit of the law and what it intended legislation should already have been passed to re enforce it in a modern world rather than tear it down.

Very seldom does the 'spirit of the law' matter. That's why laws are usually written in legalese and require a lot of education to understand them. They're usually very, very specific and have many clauses.

This is less true in places like the UK where they use a system based on case law. (A number of countries do.) They base their rulings on case history and a law may be written but enforced entirely differently. What happens then is that the rulings by the judges becomes the law (in practice) and little attention is paid to the specific verbiage.

We have a different system in the US. We have conflicting rulings, different courts, and various levels of courts - from district to State to federal.

By all this, I mean you're RIGHT. Yes, the spirit of the law should be something taken into consideration - but it will actually require specific laws to be enacted to create such rights.

I know many folks on the right don't agree with all their choices, but one such agency to strive for our rights has been the ACLU. If you're not interested in donating money, they can often use physical labor. You can even pick what you help for.

I donate - but I've also gone and stuffed envelopes and made phone calls. Do you know what I did so for?

Well, in the State of Maine, we now have a law that severely limits the police's use of automated license plate scanners. Each use must be for a specific suspect, must be for a specific period of time, may only be used in certain areas, may only retain the data for a certain period of time, and only the data regarding the initial case can be used.

That's why I support the ACLU. That's what I stuffed envelopes and made phone calls for.

They aren't all a bunch of liberals who are trying to cede power to the government. They've even fought for the right for the KKK to march in a predominantly Jewish neighborhood. They've even been on the right side of the 2nd Amendment.
