unless you have legal representation present
I keep hearing this. What exactly does having a lawyer next to you do if you're still talking? Is he going to stop you from saying the wrong thing before it comes out of your mouth? If anything instead of talking but having your lawyer present, it should be 'they talked to my lawyer while I was present'.
"Your honor, my client may have said that when the feds came to talk to him, but I was present so it shouldn't count against him"
The lawyers could suggest their clients to not answer questions when they don’t have to.
You’re not obligated to answer questions to these glowniggers.
You're right. In this specific context, as per this video, I would advise saying NOTHING and immediately contacting a competent criminal defense attorney. You probably wouldn't have your lawyer present while you got initially approached by investigators. What I meant was that if you were arrested, charged etc you should not ever try to make deals with prosecution or argue in your own defense. As you have pointed out, better to let the lawyer do the talking and only speak when he instructs.
Sometimes you can avoid prosecution or get charges dropped very quickly if you have a criminal defense attorney on retainer and don't incriminate yourself.
