Since Russia is not under the Rome Statute, and therefore not under the ICC, wouldn't detaining Putin be an act of war?

It would be. It's all just for show anyway. The ICC has no teeth and even Dubya the Inbred signed executive orders to ignore it or "rescue" any US citizens they might have to try them for whatever.
