3D TEST

The Report also uses the term “new antisemitism”. This term has not been codified in the Czech legal environment, but from the point of view of FJC it is a useful methodological instrument as it correctly reflects the essence of the illegitimate criticism of the State of Israel as defined in the above-mentioned working definition of antisemitism. The concept of new antisemitism refers to the “3D test” devised by Natan Sharansky. According to the test, to be considered antisemitic, an utterance must contain at least one of the 3 Ds.

The first D stands for Demonisation, i.e., the portrayal of Israel as evil incarnate and aggressor. An example is the comparison of the policy of the State of Israel to Nazi Germany or of Palestine refugee camps to concentration camps etc.

Sharansky uses the second D to refer to the Double Standards applied selectively to the State of Israel when judging its foreign policy or home matters. Especially in the UN context Israel is often the target of many biased condemning statements and resolutions while other, often undemocratic, authoritarian and totalitarian states do not have to face criticism and are many times the ones ac-ting against the State of Israel as arbiters of observation of international law and human rights.

The third D stands for the Delegitimization of the State of Israel and refers to the denial of the right of the State of Israel to exist.
