There is no such thing as criminal qualified immunity. If he committed a criminal act, he does not even have civil qualified immunity, either. The courts have determined that a police officer, in the commission of a crime, does not have qualified immunity. The courts have said that law enforcement officers only have qualified immunity when they are acting within the constraints of their legal authority. Once they start breaking the law, they are no longer within those constraints and qualified immunity does not apply.
