It should not matter to the court or the jury what people "thought" the cop was doing. Either his knee killed him or it didn't and if it did was he following procedure or intentionally murdering him in front of 20 cameras. Without motive you have qualified immunity anyway. [700x729 - 134KB]

There is no such thing as criminal qualified immunity. If he committed a criminal act, he does not even have civil qualified immunity, either. The courts have determined that a police officer, in the commission of a crime, does not have qualified immunity. The courts have said that law enforcement officers only have qualified immunity when they are acting within the constraints of their legal authority. Once they start breaking the law, they are no longer within those constraints and qualified immunity does not apply.
