Yes, I know about 18 U.S. Code § 242 - Deprivation of rights under color of law. 242 is a criminal statute, and as such requires a US Attorney / DoJ to apply it. Do you really think that the DoJ is going to bring Biden to trial? I think not.
Now, 42 US Code § 1983 - Civil action for deprivation of rights - is a civil statute, that the great unwashed citizenry can bring. It is not criminal, so no prison time, just monetary judgments.
