OSHA Emergency Temporary Standards (ETS) Covid-19

A summary of OSHA's Emergency Temporary Standards are outlined below for your reference. • Covers all Employers over 100 Employees. • Covered Employers must develop, implement, and enforce a Mandatory Covid-19 vaccination policy unless they adopt a policy that allows employees to chose to be vaccinated or test weekly and wear a face covering • Effective immediately – November 5, 2021 • Requires Employers to pay paid time off to get vaccinated and to recover from any side effects. • Requires Employers to determine vaccination status of each employee and keep records. • Requires Employees to provide prompt notice when they test positive. Employers are then required to remove the Employee until they meet return criteria. • Ensure each worker who is not vaccinated must be tested weekly (if employee is there weekly or within 7 days before returning to work). • Ensure each worker who is not vaccinated must wear face mask when indoors or in a vehicle with other employees. • Employers are not required to pay for testing or face coverings. • Employers must comply with ETS within 30 days and testing within 60 days. • ETS preempts Cal OSHA. • Cal OSHA - California Employers still required to have a Covid-19 Prevention Program and mandatory reporting remains.

OSHA does not pass laws. They publish workplace rules.

The problem, is that Federal courts enforce OSHA rules/fines and allow OSHA complaints to be the basis for employee lawsuits.
