basically your employer is the only one that will be holding the bag on this. the government might have to because they are the largest employer but that just means you are sueing an already bankrupt country where you claim will be the last on the list to be filled. governments know it is illegal to mandate it so they push removal of federal funding to whip the private businesses into performing the illegal task for them, very nice liability shield they gave there
