Military Commissions is not going to try people of the US; ‘§ 948c. Persons subject to military commissions ‘‘Any alien unprivileged enemy belligerent is subject to trial by military commission as set forth in this chapter. Alien: an individual not a citizen of the United States of America. Unprivileged enemy belligerent: engaged in hostilities against the US or its coalition partners. Military Commissions Act of 2009.

If you look at the active cases, they were al Qaeda/terrorist actions.
