This is really twisting what the documents actually say. Denna Henshaw's lawyer is saying that the information the accused is seeking is not "material evidence" relevant to the criminal charges against him. Therefore, they have no "material evidence" to offer in the case and seek to have the supeona for Denna Henshaw quashed.

Also Alberta came up with a three stage plan for reopening prior to June 1, 2021. The province entered stage 3 on July 1, 2021 before this supposed to be decision.
So what did the July 1plan include?

Alberta’s requirements for isolation (if you have symptoms) and quarantine (if you have been exposed to COVID-19 through a close contact) remain in place. Provincial quarantine rules for returning international travellers have been lifted, but federal requirements remain in place.
Starting July 29 Close contacts of an individual with COVID-19 will no longer be legally required to quarantine, unless directed to do so by local public health. Individuals with COVID-19 symptoms and confirmed cases will still be required to isolate. Hotel rooms for isolation will be available on a reduced basis.
Starting August 16 The 10-day isolation period following a positive test result will no longer be mandatory, but will be strongly recommended.
