If this does become a case; it's going to be super interesting. The military cannot sanction him for making a TikTok video on his own time. As a State actor, military personal are protected pretty extensively by the 1st amendment. He can speak his mind, so long as he makes it clear they are his thoughts and are not spoken on behalf on the military.
So long as he doesn't do something stupid and illegal like Bradley Manning (I use to support Bradley, but upon a lot of reflection. I think Assange was perfectly right, morally and legally, for publishing Manning's stuff. Manning however did commit and act of treason and broke his oath. It wasn't simple whistle blowing either.
