Participating in an insurrection? I don't think so, if i am wrong please correct me. If no one has been charged how could Trump be accused of inciting something that did not occur and no one has been charged with?

Donald J Trump was charged with the crime of insurrection..

Remember ,impeachment has two parts to it.

  1. House of Reps INVESTIGATES the crime committed and decide whether to charge or not..
  2. House of Senate TRYS the charges...

I hope this helps...

Not exactly. The house of Reps didn't investigate. Nor do they charge crimes. He faced no jail time with impeachment charges. Had they convicted him it was solely to follow that up with a vote to prevent him from holding a federal office. A federal prosecutor would still have to get an indictment, charge, prosecute and secure a conviction of inciting an insurrection in order for him to face jail time.

  1. THEY FAILED to do their part by not fully investigating.

  2. THEY did charge him with the crime. > you cannot have a trail without being charged of a crime

  3. his charges of crimes where tried in a court. > your own words " Had they convicted him "

Yes the House of Senate *found DJT not guilty *of the crime he was charged with.

Fact : not everyone charged with a crime goes to jail.. Ever hear of a speeding ticket? you get one go home and when the court date comes you appear before the judge.

LOGICAL THINKING.....

He was politically charged with inciting an insurrection not criminally. I suppose I could or should have asked has anyone who has been arrested from the Capital incident been charged with participating in an insurrection? Neither the House nor Senate can imprison someone. Hell Alcee Hasting was impeached and convicted and still allowed to hold office. If Trump had been convicted on impeachment he still would not have had a criminal conviction on his record, nor faced jail time, merely a political conviction in a political not criminal setting. So has anyone been charged by a federal prosecutor with engaging in an insurrection?

Incorrect. He was charged with inciting an insurrection.

Is it possible you have forgotten that Inciting an insurrection is a worse crime than committing insurrection ?

I'm still aware which one is worse. Maybe I'm missing the point you're trying to make?
