This is more about contract law than a bunch of Marxist misfits making the rules as they go along. The city and Trump signed a contract agreeing to rules/terms before he started the project. I'm sure Trump didn't sign something that wouldn't let him live there for periods of time, especially if he knew he was going to someday be GEOTUS to drain the swamp. Ironically, NY is much swampier than Florida.
