You could have subpoenaed based on any lawsuit against them. Them suing Giuliani doesn't make it somehow bad for Dominion. In fact, it makes it worse because Dominion can object to subpoenas that aren't specifically related to their case against Rudy. In other words, the lawsuit is based on what Rudy knows, not what he could have learned from a subpoena.
