It doesn't say whenever the military considers. It states whenever the President.
Biden has the power to use militias, and the armed forces to suppress a rebellion.
Anyone who does not recognise Biden as president can be arrested by the military. That's what it says.

Maybe that's why on January 21, 2021 the Biden administration passed a law that will imprison anyone who doesn't accept him as the leader, right?
Now, anyone who turns their back to Biden will be arrested.
