If you were Durham and you were a pretty well informed guy, you might know that the Supreme Court was compromised. You might know that any case brought before it might not be fairly heard based on bogus standing arguments etc.. This was shown to be true by the actions and inactions of the SCOTUS with the Texas litigation etc.. No case brought before them would be fairly heard.
If Durham knew that and wanted to win, he would wait until there was a court available that would actually hear the cases.
That would have to be the military tribunals.
