Here are some thoughts on what will happen this next week - starting TOMORROW -
Sunday, Jan 3 - Election for the Speaker of the House. In order to vote for speaker, apparently you need to be physically present and can't ZOOM your vote in via the web. If enough democrats do not show up (doubtful) there is a possibility (ice cubes in hell) of a republican being elected Speaker (as if Pelosi will allow that to happen). There also may be some games in terms of seating House members. This has had some SCOTUS decisions - but, I'm thinking that there will be something about this coming up.
Monday, Jan 4 or Tuesday Jan 5 - Convening of the 117th Congress and the adoption of rules for the House of Representatives and the Senate. I'm sure that there have been some changes slide into the rules of both the House and Senate that will "help" with how the electoral congress is handled (you can bet on that). Specifically if it will be one vote per representative (democrat advantage) or will it be one vote per state (republican advantage). The Constitution specifies one vote per state with respect to the electors - but how will it be handled for the 2 hour discussion when electors are challenged? Will the rules be altered so that the challenges are automatically disallowed by the Speaker or Majority Leader? That may be a main question. The other question is just how badly will the RINOs push down the challenges in the Senate and how badly will McConnell join with Schumer to drop the hammer on the challenges.
Wednesday Jan 6 - Regardless of how VP Pence handles the opening of the elector certifications - It has been reported that McConnell and Pelosi have been huddling on how hold down the republican objections. Pence is in control of the joint meeting of the Congress. He is going to have to exert control or McConnell and Pelosi will just run over him. Pence as President of the Senate is going to have to exert some sort of control over the Senate's discussions of the objections.
Just how many objections - in that there are a total of 7 states potentially in play. McConnell, Schumer and Pelosi will try to group the objections into one bucket for a single 2 hour conference session - rather than 7 individual 2 hour sessions per state. Also, here are some thoughts as to what might happen.
Games in the Senate. I'm almost willing to bet, that they will try to limit one objection per Senator, so as to try to limit the objections. With 140 republicans willing to object in the House, that will not be a problem. By limiting the Senators, you can probably cut the objections down to 3, if Senators are limited to 1 objection each. There will be a parliamentary fight over this.
Games in voting - Again, vote by representative or by state is the main question that will rule the Electoral Congress. How that is handled is the key.
Opening the elector's certificates - That is the entire question of the law of 1887 or the 12th Amendment - which one rules.
Trump's Presentation - Trump wants some sort of presentation on election fraud. McConnell, Schumer and Pelosi will smack that down (probably via the new rules) as quickly as stink on S**t. Never been done before, they will not allow it this time around. There will be a floor fight on this - and Pence will need to rule on this.
This is going to be at least 4 days of all out political warfare. The democrats will not go quietly. McConnell has already signaled that he is happy being in the minority, and willing to compromise on just about anything. The democrats will steam roll, and the RINOs are more than willing to lay down.
The question is - just how badly will WE get screwed? Just one more observation - if Trump looses, everything Trump has been doing in terms of EO's will be used AGAINST US.
