my health conditions with my doctor without my knowledge or permission"? This seems like it is a HIPAA violation to be discussing my prescriptions without my permission. So I called the doctor's office for clarification and spoke with my doctor's Medical Assistant.

According to the MA the pharmacy sent a letter stating I gave them permission to contact my doctor regarding my asthma medication (which I never did and she is sending me a copy of the letter). I'm astounded that a pharmacy thinks that they are better at determining what...

medication I should be on than my doctor. The inhaler I use is PRN (when necessary) the medication they were pushing is a daily medication which is more expensive which I don't need. I'm shocked that this is happening and no one is discussing it. Let me know what you think and

if anyone has had a similar experience. According to the MA this is a recent push from two major pharmacies in this area over the last 2 months and it's not just asthma medication its several medications treating all types of issues.

Since many of you asked. I use CVS, but the Medical Assistant at my Dr.'s office said "Both Walgreens and CVS have started doing this in the past two months to several of our patients. The other pharmacies (HEB, Walmart, etc) do not. It's just the two major retail pharmacies".

Maybe it’s one of those questions you click on when paying for your medication. CVS has questions on the screen when you pay. Perhaps they have one that says,
“I agree to allow the pharmacist to discuss my medication with my physician” Y/N
That could give them permission.

Possibly. But I am one of those people that actually reads the documentation before signing. I would have remembered if I just gave away my privacy rights to the pharmacy to discuss my health without me being involved in the conversation.

Some comments:
Major pharmacies are backed by big pharma and get kickbacks just like the Drs do.
Sounds like the pharmacies are trying to maximize sales by changing a prn to a daily (also more expensive). Pharmacies do check your prescriptions to see if there are any medications that interact w/others you are taking - one of a pharmacists main duties, but to contact or discuss your personal medications with anyone, doctor or not, without your express permission is a HIPPA violation.

My dad told me the same story just last week. Dad went to renew his prescriptions and the pharmacy he has been using for years tried convincing him to go to another medication. They even implied that the medication he had been prescribed for years was somehow inferior to their higher priced alternative. He was asked to contact his doctor and request the change.
Feeling a little weary of the situation he went literally across the street and his prescription was filled without question.
Pharmacies are being required by both the govt and insurance companies to do "Medication Therapy Management". Patients using only a rescue inhaler for asthma are at higher risk of requiring hospitalization. The profile was flagged for the pharmacy to send a letter to the prescriber's office recommending to add an inhaled corticosteroid like Flovent to reduce the chance of a serious asthma attack.
There is no HIPPA violation. There is no sinister kickback scheme (at least at the pharmacy level).
