When taken to court such as the NYT or Facebook Fact Checkers all they have to do is call them opinions. Its willful misinformation and when pressed they call it opinion or entertainment like the Rachel Maddow Show.
Misinformation is relative, if I call what I say information, and you deviate from my official information, I could say you're relatively misinformed as to my official content. I could be bonkers insane and factually and experimentally wrong, but you're still misinformed. Word games mate, word games.
Your definition absolves them of responsibility. What they're doing is deliberate.
