Apparently the current indictment has a maximum sentence of five years. But often that's a plea tactic to say, well, we don't know how many indictments we're going to give you. You could always not plead and you'll find out, or we can drop this and convert it to another charge and restrict our description of the crime to get more favorable sentencing. At a five year max it's not unheard to get probation if the judge see's you favorably and there are no priors. Although he's practically been in fight for 8 years and judges don't see that favorably, and continued his activity while his freedom was restricted which kind of tells you how their probation would go.
