You cannot legally count ballots outside chain of custody. They have hundreds of thousands of ballots and many machines which do not have a chain of custody document. For machines that means any vote cast cannot legally be counted on that machine.

Here's the big question, what does the law say should be done with ballots without a chain of custody? My guess is that the law doesn't say. So, from a practical standpoint, it doesn't matter.
