Why do you think that the feds aren't arresting all of the weed dispensaries? They are breaking federal law. But the law is nothing more than ink on paper. If no one enforces (executes) it, it does not matter what the law is. The Constitution says that "executive Power" is given to POTUS. Executive power means the power to execute or not execute laws. When you execute a law, you arrest someone for violating it. This is why the DOJ, DA, FBI, and police all fall within the executive branch of their jurisdiction. Congress does not have the authority to arrest and prosecute people for the statutes they create. Only the Executive Branch does. Because it is the EXECUTIVE Branch. It is literally in the name. The EXECUTIVE Branch EXECUTES the laws. What the fuck.

To change law requires congressional process. Neither judges nor potus get to casually claim laws simply no longer apply to them. Our founders made clear this is absolutely not the case. The recent outcry of unconstitutional rule by decree in the last decade plus makes the point.
Additionally the process is plainly laid out. The potus authority here is veto, sign, ignore. That's it.
You might have a leg to stand on if law didn't already exist. Meaning he could by EO move it because it is under federal purview. But he does not have power to arbitrarily change laws. This is clearly defined in detail by the US Constitution.

Also, POTUS is literally above the law in his official capacity because he is a separate, equal branch of government. POTUS is, by himself, an entire branch of government, it's called the unitary executive. Look up the Nixon stuff. The biggest concern was whether or not he would actually allow the DOJ to prosecute him. Because he could have just fired everyone that was going to prosecute him and it would have been 100% within his authority to do so because of the unitary executive principle. He has ALL executive power. So he could just refuse to enforce the law against himself if he wanted.
