It wouldn't pass constitutional muster even in the Senate voted it up and Biden signed it. This alters the substance of Article I and Article II, which delineate how federal elections work. And Amendment X, which says that unless a power is specifically granted to the feds as a power in the constitution, it's in the hands of the States and the People respectively. That means that the feds can't take over state elections without changing the Constitution to say that they can. It's not exactly going to fit under the "penumbral emanations" of the Commerce Clause THIS TIME.
Oh yeah, I’m sure the constitution still matters.
