They cannot. This is a common argument. It is called amendment by re-definition. The courts cannot redefine terms/words of the Constitution to make alternative interpretations. That's why they use Bouvier's Legal Dictionary 1865 edition.

Constitutionality is based on forefathers intent, not current uses of old words.

USED TO BE TRUE, not for a very long time. Courts can and have and continually do redefine terms and words in the constitution to support anything they want.
