It's kind of a problem to shoot someone that is fleeing. In most cases, you really can't even shoot someone for property theft... unfortunately.

The guy had a weapon and he was advancing. The old guy had every right to believe his life was in danger. What he did wrong was not to completely empty his gun while the guy was coming at him.

I was taught that once you start firing a gun, you fire until the clip is empty and you aim for center mass. Because I was a poor cop's kid, we'd practice with cereal boxes nailed to trees at adult chest height.

It's also apparently really funny to have your skinny 8 year old shooting a .45 revolver.
