Exactly, how does one counter if the jury clearly states they believe the Prosecution proved all charges beyond reasonable doubt, not only find the defendant guilty but also strongly concur with the prosecutions recommendation for the longest sentence possible as a deterrence to any future 'unlawful vigilante killings' ??....
I believe the judge can step in and nullify.
On what legal grounds ??. Correct me if i'm wrong, but a Judge can only nullify if 'a verdict didn't come about lawfully' (clear evidence of bribery, threats, coercion etc), was improperly instructed or declare a mistrial if after jury polling the verdict wasn't unanimous. I men i don't know for sure bc attempting to find accurate source info - depends on how you go about sourcing the info and even how the question is parsed - NOTE, not a lawyer....
A judgment notwithstanding the verdict (or JNOV) is an order by a judge after a jury has returned its verdict. The judge can overturn the jury's verdict if he or she feels it cannot reasonably be supported by the evidence or if it contradicts itself.
