Not versed enough to answer as to legality, but we all know this is a political show trial that should have never happened.. so I suspect that the prosecution will try to end it in a way that allows them to try again.

We non-lawyers would assume that the defense strategizes in relation to the charges, so it seems that adding or altering the charges mid-trial would give the prosecution an unfair advantage. Sort of bait and switch.

Im sure they want to try a plea bargain type deal where Kyle is "guilty" but sees no jail time. This way the left get their lamb, and the right is appeased
