One can't. You are correct that one cannot prove a negative. But its a common tactic that authority figures use where its YOUR job to prove you aren't in the wrong.
So it would seem only fair to at least investigate the shit outta the phone, the plan, the provider, going even so far as to hold it as evidence of a crime. You know, the way it would be if someone did this for say.. the Chauvin trial.
