if this was in a public venue - taking the phone was a violation of civil rights, and deleting it had zero effect (undeleting IS a thing, idiots) .... if the video was made in the lobby of a hotel, etc .. its a little bit more problematic - the police are likely STILL guilty of violating 1st and 4th amendment rights.
