If you read the OSHA statement carefully, it is actually guidance that says they won't ENFORCE the requirement. They didn't change the laws or regulations, they simply stated THEY wouldn't be enforcing this provision.
They carefully did not say anything about the liability an employer might have under existing laws or regulations in the event of a civil suit.
