I can picture the scene: guy and his friend are snorting coke and eating/snorting/injecting morphine pills. The dead guy seems to be on methadone maintenance- really effective, isn't it?
So they're both all lit up, and then the dead guy ODs or starts complaining about his heart. His junky friend probably knew there was a problem, maybe even watched the guy fall unconscious and start choking. Probably ran around the house disposing of drugs so that when the police came to get the body, he wouldn't get in trouble- that's how junkies think. Their best friend could be fucking dying right in front of them, in desperate need of help where every microsecond counts... but their junky friend will be more concerned with getting in trouble.
This has led to a lot of state relaxing laws surrounding situations like this. They want people to be more likely to report ODs and save lives, so cops won't arrest junkies at the scene of an OD, even if their pockets are stuffed with heroin. Cops'll probably just take it from them, and fucking sell it to one of their informants to make a quick buck (cops do this more often than you'd think).

It's not unreasonable, if I had a junkie dying on my floor I'd certainly be more concerned about being in the clear legally than I would be with helping him, and that's how it should be, we don't need to minimize the deaths of drug addicts and those who associate with them as they're a lost cause to begin with.

Sounds more like the states are encouraging drug use with such leniency when instead anyone who was in the room during the drug use should be charged.
