2nd degree is a little odd. The article states they must prove "intent to harm". Well yeah when you have some big gorilla flailing around and refusing to comply of course you want to harm him if it means you can get him to comply and get in the car.
In order for him to get off on all charges the entire jury needs to agree that he died strictly from an OD.
