That's not a given. If the SUV driver had no insurance and was transporting people who weren't secured, overloaded the vehicle and most likely harboring illegal aliens he'll be lucky to stay out of jail on all counts. I'm betting he is the cause of the accident.
It's california. It's routine lefty behaviour these days to arrest the victim whenever first class citizens (ie. high melanin noncitizens or heebs) are involved. I have no doubt they could find some way for it to be the truck driver's fault and cook up some story about starry eyed new-americans being mercilessly cut down by a racist trump supporting bigot.
Quite possible. Much depends on the responding officers and how they first write it up and then to the prosecutors.
Back middle of last year I was doing security watch as a volunteer at a church and next door at a recent house renovation by an investor three guys lined up on the back door in plain sight of myself and kicked in the door. At first I ignored the noise then started looking across and saw them literally kick in the door to enter. I should have taken out my cell phone and videoed the entire incident but I was just in a state of disbelief as it was in the middle of the day when things like that don't usually happen.
I called the dispatch and told them I was watching the entire time and gave them a moment by moment account of the three hoodlums doing the break in. Gave them a description and when they left they walked right by me as I was on the phone with police. Didn't even bother confronting me or glance at me. Walked by within touching distance.
Two cop cars with four cops arrived and I pointed to the houses the perps escaped to and described them. Cops only wanted all my details, my ID, and blah blah blah and never sent anyone to go knock on the doors I pointed out. Easiest arrest possible and there was another resident who came out of the house next door and witnessed it and the police didn't question that person either. Finally the cops said they had another call and rushed off to be replaced by three more cops of which, only one really wanted a description of the perps and seemed interested in the actual crime and went over to examine the busted door. Were the perps arrested? I have no idea. I also notified the invester and their real estate company.
That's nuts. Unfortunately it's what I've come to expect of most police. Friend of mine had a similar story: Some kids started smashing his car windows, so he called the guards (nearest station just down the road). They said they'd come down but never showed up. A few hours later same kids came back doing the same thing. Called the guards, we'll be there in a minute, never showed up.
These days, most commercial trucks have dash cams. It's highly likely the SUV driver was completely at fault. As long as the gravel company has the dash cam, they'll survive. From the picture, it looks like the SUV has a stop sign and the gravel truck had the right of way.
That was my impression.
