Immunity is given where no reasonable cop would know not to light up a gas soaked man. The doctrine has been expanding so that the bar is pretty low now.
Yeah...I don't give 2 shits. He didn't respond to the pepper spray first used, had a lighter and was covered in gas. I mean, yeah, he probably should have just been shot and killed but seems this did the trick. Sorry, not sorry.
His point is the qualified immunity is slowly being expanded to cover any situation where cops feel "threatened". Approached an officer with out a mask? That's a shooting. Open carrying and declining to have your vehicle searched? That's a shooting.
