Notice it's "access" and not "must use"? Setting federal guidance that forbids discrimination is fine because it isn't telling anybody which bathroom they can or can't use. It's policing the school boards, not the bathrooms.
Let me put it this way: just like the Constitution explicitly says what Congress cannot do, a POTUS saying what public entities cannot do (i.e. discriminate against people based on gender identity) doesn't count as government involvement in public affairs. It's government policing government.

It's good that you concede that it's a basis. It's actually really important we agree on this. Now keep that thought going--if it is the basis but a basis is only a starting point, then gender identity does not have to stay the same and can end up completely different than the biological origin.
Now add in the non-obvious cases--biological hermaphrodites (both sex organs) and overproducers of hormones who develop the "wrong" way (like a boy growing breasts at puberty or a woman who grows facial hair) and you can start to see how body dysmorphia is a legit disorder with no one-size-fits-all solution.

literally this still happens (predators sneaking into girl's bathrooms) when it's still biological split bathrooms (probably because they're already planning on breaking a much much worse law)
yet it's so rare (when you exclude instances of protestors deliberately doing it to try to "prove" that it's not a thing) while the flipside is so common--transgender people forced to use bathrooms that don't match the gender that they look like, causing instances of violence--that you're essentially describing pulling the trolly lever to kill thousands on one track to avoid the one or two little girls on the track you were on
