Probably because the one thing the Constitution does give power to is the federal government over borders. So, technically and legally, the country's borders are the property of the feds.

I am not a legal scholar or expert, so could be wrong.

They should make it a capital crime to interfere with that razor wire.

They are sworn to protect it. Constitutionally the power transfers to militias and anyone opposing it, including the feds or military are traitors. This is what the rule law actually allows.

By failing to uphold their oath and protect the border they have abrogated their authority to We The People and our militias. That's the law. Any judge claiming otherwise is admission to treason (aid and comfort to enemies).

Well thats sort of my point - if the administration has given orders to open the borders, or prevent whatever the states are doing to their borders under the guise of 'interfering with Fed", then I would think it has a legal standing. Again, I don't know and I think the assholes that are opening the border should be considered traitors for sure... So I agree.
