Well no. I mean it is ultimately different because one can choose to smoke, while one generally does not choose to be infected with a disease. He is equivocating not getting vaccinated to choosing to be diseased, which is silly.
As per his argument of risk, people choose to do risky behavior that impacts other people all the time. Driving is always a great counter to any arguments about risk. People greatly vary in levels of acceptable risk when it comes to driving, and individuals will even vary their level of acceptable risk on a moment-to-moment basis. Everything from how they drive, what they choose to drive, the laws they support, their level of driving education, what type of insurance they get, and on and on and on, are all decisions about risk.
