Devolution and CoG. Trump called it with EOs his last week of Trump1.0. Trump never ceased to be Commander in Chief. In 2021 Biden was essentially handed a baby POTUS position to a childproofed Whitehouse. Biden's whole Inauguration Day was fucked up. Military hsd their backs to him as he passed by. Wrong number of cannon reports. Wrong formation (funeral formstion IIRC) when the jets flew over, no gold tassels on the US Flags... and more.

Even Steve Bannon was laughing about it "It's like he is still the President" (wink, nod) as they watched Trump swearing in at noon today.

No dodge. In the Devolution theory, Trump already is Commander and Chief. Get it?

Melania wasn't at Trump's side when Chief Justice Roberts started the ceremony too quickly. She was a step or two away, got in position and held them out but Trump didn't move his hand after he had started the oath. I don't know if this was accidental or on purpose.
