That isn't what happened. At all. The charge wasn't dropped but the judge specifically state that it's still open to be challenged to be dropped again and his mind isn't made up. Watch the ACTUAL hearing and not some (((news))) about it. IIRC it's near the end.

So for example, generally (always) when a motion is brought to modify something in a trial that the judge has control over and it's denied then it's not to be "remotioned" for to be dropped again. The only method of doing that would be to appeal the denial to the next level court up. Which takes months and months and months of waiting.

In this instance with regards to the weapons charge the Judge is still completely open to dropping it but wasn't sure about it at that moment. He explained it as such in the hearing: again, watch the whole hearing yourself. It's only like 56 minutes long until the Daubert hearing (which is like 2.5 hours and boring).
